TICKET TERMS & CONDITIONS

1 Definitions and interpretations

In these Terms and Conditions the following terms shall have the following meanings:

Event
means Rebellion Festival and each of its constituent events in each year;

Force Majeure
means any condition or event beyond the reasonable control of Rebellion which directly affects the performance by Rebellion of its obligations and makes such obligations impossible, impracticable or infeasible and/or which may prevent Rebellion from hosting or staging the Event (in whole or in part) at a Venue and which includes: threats or acts of terrorism or war; riots or other forms of civil disorder; public disaster; epidemic; pandemic disease; fire; explosion; strike or lock-out; failure or absence of essential services such as national or local power grid, water or other utilities; power failure; failure of technical facilities; Royal demise, royal succession or national mourning; acts of God; earthquake; rare or unpredictable weather conditions; adverse or inclement weather that is not rare or unpredictable (but is serious enough to prevent the Event taking place); or any other cause outside of the control of Rebellion. A Force Majeure Event will also include any laws, rules, regulations, instructions, orders or guidance from any relevant authority (including advice from the relevant safety advisory group or licensing authority) which would or may: prevent the Event taking place; materially affect the capacity of a Venue; or which would impose other restrictions on attendees (including travel restrictions, data capture, quarantine, social distancing measures or other screening); and/or prevent the Event proceeding as originally planned;

Guest
means any individual invited by you or accompanying you to the Event and to whom you have provided a Ticket;

Official Website
means the official ticket website for the Event via which Tickets may be purchased (www.rebellionfestivals.com);

person
means an individual, partnership, firm, corporation, association, trust, unincorporated association or any other legal person;

Terms and Conditions

means the terms and conditions set out below, together with any rules and regulations of the owner or operator of the relevant Venue and any other rules brought to your attention prior to purchasing the Ticket or entry into a Venue;

Ticket Agent
means our ticket sales agents appointed from time to time;

Tickets
means evidence of a personal revocable licence for an individual to access the Venue and attend and to occupy space (or where there is allocated seating, a seat) at the Event (each a Ticket);

Venue
means Winter Gardens, Blackpool and any other venue at which any part of an Event is held;

we/us/ Rebellion
means, Rebellion Festivals Ltd (company number 07602338) whose registered office is at Unit 2, Foley Works, Foley Trading Estate, Hereford, HR1 2SF;

you

means the purchaser or the holder of the Ticket; and

Your Content
has the meaning set out in clause 14.1.

2 General

2.1 All Tickets are sold and issued subject to these Terms and Conditions, together with any terms and conditions set out by the Ticket Agent. Where there is a conflict between these Terms and Conditions and those of the Ticket Agent, these Terms and Conditions shall take precedence.

2.2 By purchasing a Ticket or holding or using a Ticket, you agree to comply with these Terms and Conditions. You will ensure that each of your Guests will also comply with these Terms and Conditions.

2.3 If you do not (or any Guest does not) comply with these Terms and Conditions, both we and the Venue may terminate the licence(s) granted and remove you (or any Guest) from the Venue.

2.4 The version of these Terms and Conditions in force on the day you purchase the Ticket shall apply to you and your Guests. However, we reserve the absolute right to change these Terms and Conditions from time to time without notice. Accordingly, you should check these Terms and Conditions each time you make a purchase.

3 Ticket Purchase

3.1 Tickets may be purchased (i) from us (a) in person at an Event for next year's event, or (b) via the Official Website, or (ii) via an official Ticket Agent. Any Tickets purchased or obtained from any other source shall be voidable by us or the Venue (at our option) and may be seized or cancelled by us or the Venue without refund or compensation.

3.2 All prices are inclusive of any applicable taxes. Ticket Agents will state the face value of the Ticket and in addition to this may charge a booking fee, transaction fee and delivery fees.

3.3 All Tickets are subject to availability and orders are subject to acceptance by us and/or the Ticket Agent.

3.4 The information provided to us and/or the Ticket Agent when you place an online order will be used to contact you and/or to fulfil any orders. You should ensure that all information provided is correct. We shall not be liable for the incorrect entry of information or for any lost or incomplete orders caused as a result of providing incorrect information.

3.5 We may, in our absolute discretion, refuse any order or cancel any order or withdraw any Tickets where we believe you (or any Guest) plan to offer a Ticket or Tickets for resale (or have resold any such Tickets) or where the purchase or use of such Tickets is otherwise in breach of these Terms and Conditions.

3.6 Sales of any Tickets are final. No changes, cancellation or exchange of any Tickets (or any element of such Tickets) will be permitted, except if the Event is cancelled or moved to another date or as authorised and facilitated by us from time to time (in our absolute discretion).

4 Tickets and entry into the Event


4.1 All Tickets purchased online will be issued to you by email to the email address you provide or issued to you by post to the address you have provided.

4.2 If your confirmation email with printable tickets has not been received or you have not received your Tickets 7 days before the commencement of the Event, it is your responsibility to contact us or the Ticket Agent.

4.3 You are responsible for checking all Tickets on receipt as mistakes cannot necessarily be rectified later. If there has been any mistake you must contact us or the Ticket Agent without delay and at least 7 days before commencement of the Event.

4.4 Where you have opted for e-Tickets, hard copy tickets will not be provided. You must follow the instructions in your confirmation email and any subsequent correspondence about printing your Tickets.

4.5 You are solely responsible for safeguarding any Tickets purchased at a previous Rebellion event, or, if you purchase your ticket online, you are solely responsible for safeguarding your confirmation email, all Tickets you print and any Tickets sent to you by post. We shall not be liable for nor compensate you for lost, stolen, forgotten, defaced or damaged Tickets. Your Ticket may not be valid if part of it is removed, altered or defaced. No duplicate Tickets (or wristbands (see below)) will be issued in any circumstances.

4.6 On arriving at the Event, your Tickets must be presented at the box office where they will be exchanged for wristbands. These wristbands will gain you access (and re-access to the Event as applicable based on the Tickets you purchased), not the Tickets themselves.

4.7 We may ask that the cardholder presents the card that the Tickets were booked on as identification or we may ask for other forms of ID to verify that you and your Guests have acquired your Tickets in accordance with these Terms and Conditions.

4.8 You and your Guests must retain their wristbands at all times while attending the Event. Wristbands and/or proof of your or any Guests identity (with appropriate photographic identification) must be produced for inspection upon request by any official, steward or third party authorised by us at the Venue (or any police officer) and/or on re-admission. Failure to do so may result in you or your Guest being asked to leave the Venue or not being allowed to re-enter the Venue.

4.9 We reserve the right to refuse entry or remove you or your guests from the Venue at any time if: we have any health and safety concerns; you or your Guests behave in a manner which has or is likely to affect the enjoyment of other persons at the Event; you or your Guests act in a threatening, abusive or insulting manner; if in our opinion you or your Guests are acting under the influence of alcohol or drugs; if you or your Guests fail, when required, to produce proof of identity or age; if you or your Guest engage or appear to be intending to engage in any form of commercial activity at the Event, or collect any data or record of the Event for commercial purposes; if you or your Guest engage or appear to be intending to engage in activities which will interfere with the rights of Event sponsors (including by marketing, promoting or advertising any brand, including any form of ambush marketing); and for any other reason set out in these Terms and Condition and otherwise in our complete discretion.

4.10 The Event offers re-entry, upon re-entry these Terms and Conditions still apply.

5 Event Alterations, Interruptions and Cancellation

5.1 You acknowledge that the Event may be delayed, interrupted, rescheduled, postponed or cancelled, or the running order and performer line up changed. We will use our reasonable efforts to communicate any cancellations to you (using the information provided by you where you purchased Tickets online). As soon as possible after we become aware that the Event has been or will be delayed, interrupted, rescheduled or postponed, all available information will be posted on the Official Website and/or on our social media channels. It is your responsibility to ascertain whether the Event has been delayed, interrupted, rescheduled, postponed or cancelled or whether the running order or performer line up has changed. We cannot guarantee that you will be informed of such delay, interruption, rescheduling, postponement, cancellation or running order or performer line up change before the date of the Event.

5.2 If the Event's scheduled start time is delayed but not postponed, you will not be eligible for a refund.

5.3 If the Event commences as scheduled and is interrupted after it begins, you will not be eligible for a refund.

5.4 If the artist and performer line-up or any billed attractions are changed, you will not be eligible for a refund.

5.5 If the Event is cancelled or postponed, then you may either roll over your Ticket for next year's event or apply for a refund in accordance with our refund policy (or the refund terms / policy of any relevant Ticket Agent (as applicable). There will be no on-site refunds at the Venue. If the Event is postponed, you may retain your original Ticket for admission to the rescheduled Event.

5.6 Any refund will be processed by us (where you bought your Ticket directly from us) or the Ticket Agent from whom you purchased your Tickets, as applicable. In order to request a refund, in addition to your compliance with these Terms and Conditions (and the terms and conditions of any relevant Ticket Agent, as applicable), you must also ensure that you comply with any rules (including application deadlines) set out in our refund policy (or the refund terms / policy of any relevant Ticket Agent, as applicable). Please review these terms to ensure that you are eligible for a refund and to confirm the steps you must take in order to apply.

6 COVID-19 and any future epidemic or pandemic disease

6.1 In light of the COVID 19 pandemic, you understand that there are particular risks associated with attending any outdoor or indoor gathering (including any Event). This clause 6 sets out our obligations and your obligations to reduce risks connected to the COVID 19 pandemic but will apply equally to any future epidemic or pandemic.

6.2 We will take reasonable steps to comply with any relevant guidelines intended to reduce the spread of COVID 19 and we will make you aware of these measures. However, we cannot be responsible for the behaviour or health of other attendees and cannot effectively ensure that no attendees at any Event will have COVID-19. Accordingly, we will not be responsible if you or any Guest catch COVID-19 at an Event or for any illness or death of you or any Guest caused by COVID 19.

6.3 You understand and accept that you will be attending the Event and using any facilities on-site at your own risk.

6.4 To help us to reduce the spread of COVID 19, we ask that you:

6.4.1 do not attend an Event if*:
6.4.1.1 you have tested positive for COVID 19 within 14 days of the commencement of the Event;
6.4.1.2 you display any symptoms of COVID 19;
6.4.1.3 you live with somebody who displays symptoms of COVID 19 or who has tested positive for COVID 19 within 14 days of the commencement of the Event; or
6.4.1.4 you are otherwise required to self-isolate.
*note that where there is a conflict between any of the provisions in this clause 6.4.1 and any updated Government guidelines or those of any relevant authority, the updated guidelines will apply where they are stricter than the provisions set out in this clause 6.4.1;

6.4.2 follow all guidelines and/or entry requirements notified by us to you and which will apply to your attendance at an Event. This may include testing on entry, re-entry or prior to attending the Event. We may be required to amend our guidelines before or during the Event and ask that you comply with any updated guidelines notified to you;

6.4.3 follow all government guidelines (which may be updated from time to time);

6.4.4 download and use the government's official COVID 19 tracing app or provide your contact details to a member of Event staff as directed upon entering the Venue for the purpose of notifying you where you may have come into contact with somebody who has tested positive for COVID 19;

6.4.5 you notify us if you test positive for COVID 19 after attending the Event so that we can notify attendees who may have come into contact with you whilst at the Event.

6.5 You understand that we have the right, at our complete discretion, to:
6.5.1 refuse entry or re-entry to any attendee who we reasonably believe may display COVID 19 symptoms or who may not have followed Government guidelines or our guidelines or entry requirements;
6.5.2 require that any attendee leaves the Event where we reasonably believe that they may not be complying with these Terms and Conditions or any of our or Government guidelines in force in relation to COVID 19.

7 Liability

7.1 You and your Guests are responsible for your (and their) own safety. You must comply with any safety regulations and announcements when attending the Event and must comply with the reasonable instructions of any stewards, officials or any of our or staff or representatives at the Venue.

7.2 It is your responsibility to check the suitability of an event for any of your Guests under the age of 16. Any Guests under the age of 16 must be accompanied by a parent or guardian.

7.3 You should be aware (and make your guests aware) that prolonged exposure to loud noise may cause damage to your (or their) hearing. Flashing lights and pyrotechnics may also be used during performances.

7.4 You are responsible for making your own arrangements to attend the Event (and those of your Guests) including travel and accommodation. If the Event is cancelled, altered or postponed, we will not be responsible for any costs of travel, accommodation or other items of expenditure which you or your Guests have incurred.

7.5 We cannot guarantee an uninterrupted and/or uninhibited view of the Event and no representation or warranty is given as to the quality, content or duration of the Event.

7.6 If before or during the Event you have a complaint in relation to the Event (including without limitation in relation to your ability to view the Event), please contact us or a steward promptly since complaints are very difficult to deal with after the Event.

7.7 Neither we nor the Venue are liable for any failure to perform any obligation under these Terms and Conditions or otherwise to the extent that the failure is caused by Force Majeure.

7.8 We will not be responsible for any business or economic losses including: loss of profit; revenue; contracts; anticipated savings; or opportunity; or any other indirect loss that was not reasonably foreseeable to both us and you when the order was made. However, subject to clause 7.9 and 7.10, we will be responsible to you for any losses you suffer as a result of a breach by us of these Terms and Conditions where those losses were reasonably foreseeable to both you and us at the date you place your order.

7.9 Subject to clause 7.10, in any event our maximum liability to you (or any Guest) under these terms and Conditions is to refund to you the price paid by you for the relevant Ticket.

7.10 Nothing in these Terms and Conditions shall reduce or limit our liability for death or personal injury or damage to your property where caused by our negligence or by our deliberate act or omission.

8 Personal Data

8.1 Where you place an order for a Ticket in person at an event or you purchase a Ticket on the Official Website, we or our Ticket Agent will gather and store information about you. This information will be transferred to Rebellion and used by us and/or the Ticket Agent to identify you and for administration, communication, enforcement and access control purposes. If you opt in, we may also use your data to send you information about Rebellion festivals.

8.2 Where you purchase Tickets from another Ticket Agent please refer to their own privacy terms.

8.3 You irrevocably and unconditionally consent to the collection and processing by us of personal information provided to us in accordance with these Terms and Conditions for the purposes of the implementation of these Terms and Conditions, and acknowledge that we may process your data as set out in our privacy policy . You have a right of access to and to correct your personal information by written request.

8.4 We will use reasonable endeavors to ensure the safety and security of any personal information you provide to us. However, except as set out in law, we shall not be responsible for any loss, theft or accidental destruction of any personal information provided to us or any financial loss or other damage which may result directly or indirectly therefrom.

9 Transfer, Resale and Use of Tickets

9.1 All Tickets are strictly non-transferable and must not be: sold; advertised for sale (whether on the internet, in newspapers or otherwise); transferred to any person who pays or agrees to pay for some other goods and/or services; nor offered as part of a package of goods or services.

9.2 If you purchase more than one Ticket, the Tickets may only be used by you, member(s) of your family, friend(s) or colleague(s) who are known to you personally and who intend to accompany you to the Event.

9.3 Tickets may not be used for advertising, promotion, auctions, fundraising or marketing purposes (including as prizes in competitions, contests or sweepstakes).

9.4 Tickets used for advertising, promotion, auctions, fundraising or marketing purposes without our authorisation (including in competitions, contests or sweepstakes) or otherwise used or transferred or obtained in breach of these Terms and Conditions shall be voidable (at our discretion) and may be seized or cancelled without refund or without granting entry to a Venue.

9.5 Any person seeking to use a Ticket obtained in breach of these Terms and Conditions in order to gain entry to or remain at the Event may be considered to be a trespasser and may be liable to be ejected and liable to legal action.

10 Prohibited and Restricted Items

10.1 We and each Venue have the exclusive right to determine what objects may or may not be brought into the Venue by you or any Guest. You shall not (and shall ensure that any Guests do not) bring into the Venue the following non-exhaustive list of prohibited and restricted items:

10.1.1 any firearm, ammunition, dangerous weapon or object, explosive, chemicals or incendiary device;

10.1.2 any objects that may cause damage to persons and/or property, or cause disturbance to the regular and orderly execution of the Event (as determined by us or the Venue in our absolute discretion) including: liquids in containers of greater than 100ml in size, needles (save as required for valid medical reasons), glass bottles or containers, weapons (including knives), illegal drugs, other illegal substances, fireworks, firecrackers, large or commercial photography equipment (e.g. tripods), high visibility jackets or bibs, personal motorised vehicles (other than mobility scooters where agreed in advance), klaxons or airhorns, blunt instruments, drones, electronic transmitting equipment (except for personal mobile telephones), flags or banners, lasers, laser pens or any other devices that in the opinion of us or the Venue may disturb the Event large quantities of coins, lighters, advertising or promotional material of any kind, printed matter bearing religious, political or offensive content or content contrary to public order and/or morality, cans, bottles or containers made of glass or other material, large objects such as suitcases or bags; any items which may interfere with the operation of any equipment used for the Event; animals or pets (save for special assistance dogs); and/or any other item, object or material that that the Venue prohibits in accordance with its terms of entry and/or which we or the Venue may deem dangerous or that may cause damage or disruption to the Event or the enjoyment of the Event by other attendees; and/or

10.1.3 food, alcoholic and non-alcoholic beverages;

10.2 We or the Venue shall have the right to confiscate any unauthorised materials or objects. Neither we nor the Venue will store confiscated and/or unauthorised material at the Venue and neither you nor your Guest will have any right for a confiscated item to be returned.

11 Forbidden Behaviour

11.1 While at the Venue you will not (and will ensure that any Guest does not) engage in any conduct or activity that, in our view or the view of the Venue, creates a dangerous situation, puts at risk an individual's personal security, is against public order, interferes with the commercialisation of the Event, interferes in any way with the orderly execution of the Event or disrupts the enjoyment of the Event. If you or any Guest acts in such a way or are otherwise in breach of any Venue regulations, we (and/or the Venue) may refuse admission, re-admission or remove you or your Guest from the Venue without refund.

12 Security Inspections

12.1 We and/or the Venue may conduct security searches to ensure safety at the Event (which may include searching you or any bags you have).

12.2 If you or your Guest refuses a security search or refuses to comply with rules and security notices published at the Venue, you or your Guest will be required to immediately leave the Venue or be refused access to the Venue without refund.

13 Filming, Photography and Taping


13.1 You consent (and shall ensure that your Guests consent) to being photographed, filmed or taped, by us, the Venue or any third party appointed and/or authorised by us or them.

13.2 We, the Venue or third parties appointed and/or authorised by us or them shall have the right to broadcast, publish, licence and use any such photographs, films, recordings or images of you or your Guests in perpetuity without requirement of the payment of money or any other form of consideration. You consent (and shall ensure your Guests consent) to such use and waive (and shall ensure that your Guests waive) any rights to object to such recording, broadcasting or other dissemination on an irrevocable, worldwide perpetual basis.

13.3 Images, video and sound recordings of the Event taken by you or any Guest ("Your Content") cannot be used for any purpose other than for private, domestic and social purposes and neither you nor any Guest may licence, broadcast or publish video and/or sound recordings, nor exploit images, video and/or sound recordings of the Event, including Your Content, for commercial purposes, nor may they be made available to third parties for commercial purposes. For the avoidance of doubt, you and your Guests may post Your Content on social media networks for non-commercial purposes.

13.4 You hereby grant (and shall ensure that your Guests grant) Rebellion a perpetual, exclusive, freely assignable, royalty-free and worldwide licence to use, exploit and distribute, by any means, any of Your Content which you or your Guests make public (including via any social media networks) and you waive (and shall ensure that your Guests waive) in perpetuity and without requirement of the payment of money or other form of consideration, all rights, (including moral rights) in and to Your Content.

14 Venue Specific Rules

14.1 The Event will be subject to the relevant rules and regulations in relation to entry into the Venue.

14.2 If you or any Guest has specific access requirements, please contact us in advance of the event, otherwise it may not be possible for us to meet your needs. All requests should be addressed to info@rebellionfestivals.com .

15 General

15.1 You and your Guests should allow sufficient time before the commencement of the Event to access the Venue.

15.2 These Terms and Conditions shall not affect your statutory rights as a consumer.

15.3 If we or the Venue delay or fail to enforce any of these Terms and Conditions it shall not mean that we or the Venue have waived our right to do so at any subsequent time.

15.4 If any of these Terms and Conditions cannot be enforced for any reason this shall not prevent the remaining provisions from continuing to apply.

15.5 Any person, other than the Venue, not party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999.

15.6 These Terms and Conditions constitute the entire agreement between the parties and no party shall have any claim or remedy in respect of any statement, representation, warranty or undertaking, made by or on behalf of any other party in relation to these Terms and Conditions or any Ticket which is not already set out in these Terms and Conditions.

15.7 Interpretation: Clause headings are for convenience only and shall not affect the interpretation of these terms and Conditions. Unless the context otherwise requires; words importing one gender include the other; a reference in these Terms and Conditions to another document includes any variation or replacement of that document; references to persons include incorporated and unincorporated bodies, partnerships, joint ventures and associations and vice versa and their legal personal representatives, successors and assigns; references to "include" and "including", shall be construed as being by way of illustration or emphasis only and shall not be construed as, nor shall they take effect of limiting the generality of any foregoing or following words; and a reference to a statute or other law includes regulations and other instruments under it and amendments, re-enactments or replacements of any of them.

15.8 The Terms and Conditions are governed by English Law and any disputes arising out of any transaction with us are subject to the exclusive jurisdiction of the English Courts.
